Article 1: Applicability

At Zoomt, we take your privacy very seriously. This means that we handle the information we learn about you confidentially, carefully, and in accordance with applicable privacy laws.

Personal data is therefore treated and secured with the utmost care, entirely in accordance with the requirements set by the General Data Protection Regulation (GDPR).

This privacy statement explains how Zoomt handles the personal data we process from candidates (registered or working temporary staff), website visitors, contacts working at business relations (such as customers or suppliers), own applicants, interns, freelancers, internal temporary staff, and employees.

Article 2: Website

Generally, our website can be visited without passing on your personal data to us. Like many other websites, this website automatically collects certain non-identifiable information about the website’s users, such as your computer’s Internet Protocol (IP) address, the IP address of your Internet Service Provider, the date and time of access to the website, the internet address of the website from which you directly linked to our website, the operating system you use, the parts of the website you visit, the pages of the website you have visited and the information you have viewed, and the material you send or download from the website.

We use this data to offer you a service or functionality, maintain and improve the website, and to make the website more personal and relevant to you. We may process this data because we have a legitimate interest, namely: to improve the website and better align it with your needs and wishes.

Article 3: Who is responsible for processing your data?

Zoomt B.V. (Chamber of Commerce number: 87584956) is responsible for processing your personal data. This means that Zoomt B.V. determines – taking into account applicable privacy legislation – which data about you is processed, how it is done, for what purposes, and for how long. Zoomt B.V. (hereinafter: ‘Zoomt’ or ‘we’) processes personal data, among other things, by storing or sharing them with other parties.

Zoomt is entitled at all times to propose to the Hirer the replacement of a provided Laborer with another Laborer, continuing the assignment, with a view to Zoomt’s company policy or personnel policy, preservation of employment, or compliance with applicable laws and regulations, particularly the dismissal guideline for the temporary employment sector. The Hirer shall only refuse cooperation with the replacement on reasonable grounds. The Hirer shall, if requested, provide a written explanation for any refusal.

Zoomt is free to make the Laborer available to one or more other hirers without the Hirer’s consent to perform work under the supervision and direction of those other Hirer(s).

Article 4: What personal data do we process from candidates?

The personal data we process depends on the services and functionalities you use. Below you will find the data that we may process at different times.

 

When you register with Zoomt via our website, we may process the following data:

  • Phone number and email address
  • Curriculum vitae (CV) (note: never put your Social Security Number on your CV!)
  • Cover letters
  • Education, courses, and training
  • Work experience, internships, and volunteer work
  • • References and testimonials (from other employers)
  • Availability
  • Photo or video (voluntarily uploadable, without consequences if you don’t. Note: potential employers can see your photo or video.)
  • Account information: employment contracts, job title, regions, applications, registration date, last login date, last modification date

 

When you start working through Zoomt, we may process the following personal data:

  • Name, address, and place of residence (NAW data)
  • Date of birth
  • Gender
  • Country (nationality)
  • Languages
  • Driving license and car ownership
  • Copies of certificates and diplomas
  • Copy of valid identification with Social Security Number (BSN)
  • Copy of bank card and start date of bank details
  • Declaration of Conduct (VOG) and other screening results (depending on the position)
  • Work permit and residence permit (if necessary)
  • Labor, placement, and training agreements, and other agreements
  • Additional labor and salary agreements, pay slips, annual statements, wage tax declarations, and declarations
  • Information about leave, illness, benefit situation, absence, and pension
  • Correspondence, complaints, warnings, reports of assessment or performance interviews, personal work notes from recruiters
  • Other data necessary for the execution of the employment contract or placement agreement

Article 5: For what purposes do we process personal data?

  • We process personal data for the following purposes
  • To establish and maintain an employment relationship with you
  • To find an assignment for you or to fulfill an assignment with a client
  • To inform you about our services and other activities (for example, via email, newsletters, company magazines, and professional literature) and to be able to make offers to you
  • To send you a newsletter, invitation, or other messages
  • To manage your personal account and to offer services on the website
  • To assess your suitability for a particular position or assignment, to provide you with career advice or to mediate you to permanent or temporary work
  • To enter into and maintain an employee or personnel relationship with you and to carry out the relevant administration for this
  • To fulfill our obligations from the employment relationship, assignment, or employee relationship, such as salary payment, the application of collective labor agreement provisions, the execution of a pre-employment screening, the registration of sick leave, and compliance with legal reintegration obligations
  • To comply with our reintegration obligations and to comply with (the execution of) a public law task
  • To comply with legal obligations, such as the identification obligation, labor legislation, tax and social security legislation, fraud prevention, and national and international sanction legislation
  • To generate management information, conduct market analyses, carry out audits, prepare reports, and to improve our services and our marketing and communication strategy

  • To file or defend complaints and to conduct audits
  • To give you access to and allow you to use our private web portals and intranets
  • To ensure the safety and integrity of the staffing industry, for example, by investigating (the prevention of) (attempts at) unlawful or criminal behavior directed against Zoomt, its customers, and employees, as well as the safety and integrity of the sector for which Zoomt provides services or in which Zoomt’s client is active
  • To participate in (industry) consultations and to consult with stakeholders, such as trade unions
  • To communicate through social media, where access to the data is limited to the data we receive from the relevant provider
  • To communicate through photos and videos of company outings and events
  • To develop web statistics
  • To answer your questions or handle your complaints via social media, email, by mail, or by phone
  • To improve our website

Article 6: On what grounds is the processing based?

We process personal data based on one or more of the following legal grounds:

 

  • The processing is necessary for the execution of an agreement
  • The processing is necessary to comply with a legal obligation
  • The processing is necessary for the pursuit of our legitimate interests or those of a third party, unless your interests or fundamental rights and freedoms that require the protection of personal data outweigh these
  • You have given consent for the processing of your personal data for one or more specific purposes

Article 7: With whom can we share your personal data?

Zoomt may share your personal data with:

 

  • Clients to whom we propose you for an assignment or where you work or will work through us
  • Individuals and organizations that must or may have information about, for example, your education or work experience, such as referees and educational institutions
  • Other business relations of Zoomt
  • Sub-processors and suppliers (such as data processors) who provide services or carry out assignments on behalf of Zoomt, including but not limited to printers, IT suppliers and hosting companies, suppliers of video interview systems, tests and assessments, suppliers of personnel and payroll administration systems, pension insurers, health insurers, occupational health services, legal advisors, accountants, insurers, tax advisors, and other advisors
  • Government agencies, such as the Tax and Customs Administration, the Social Insurance Bank, the UWV, the Inspectorate SZW, and other regulators
  • Third parties, such as service providers that process personal data on our behalf, such as an E-assessment agency, screening agencies, or other test agencies. We conclude a processor agreement with these third parties that meets the requirements of the GDPR
  • Third parties, such as suppliers of ‘tools’ for conducting video interviews and other IT systems or modules that we use in the context of our services. We are not responsible for the processing of personal data via these external systems or software. This privacy statement does not apply to this. We advise you to consult the privacy statement of these third parties
  • Third parties, such as trade unions, in the context of a (collective) employment agreement or a placement agreement
  • Third parties, such as parties involved in the transfer of (part of) our business or the acquisition of (part of) our business

Article 8: How long do we keep your personal data?

We do not retain your personal data longer than necessary for the purpose for which we have collected and processed them. The specific retention periods are laid down in our retention policy. After the retention period has expired, your personal data will be deleted or anonymized. We may use anonymized data for statistical purposes.

We have taken appropriate technical and organizational measures to protect your personal data against loss or any form of unlawful processing. We have taken, among others, the following measures:
